1. Acceptance of Terms
By accessing or using SecureSwap ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. SecureSwap is operated as a peer-to-peer digital escrow service facilitating secure exchanges between parties in India.
2. Eligibility
You must be at least 18 years old and a resident of India to use SecureSwap. By creating an account, you represent that you meet these requirements and that all information provided is accurate and complete.
3. Account Registration
You must register with a valid email address and verify it via OTP before creating or accepting deals. You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately if you suspect unauthorized access to your account.
4. How SecureSwap Works
SecureSwap acts as a neutral escrow intermediary for peer-to-peer digital exchanges. The platform holds buyer payments in escrow and seller assets in an encrypted vault until both parties fulfill their obligations. SecureSwap does not take ownership of any funds or assets. It merely facilitates the secure exchange.
5. Platform Fee
SecureSwap charges a total platform fee of 4% on each completed deal, split equally: 2% is added to the buyer's payment, and 2% is deducted from the seller's payout. The fee breakdown is disclosed before deal creation. No fees are charged for cancelled or disputed deals that result in a full refund to the buyer.
6. Deal Limits
Individual deals are currently capped at ₹15,000. This limit may be adjusted as the platform evolves. Users will be notified of any changes to deal limits.
7. Payments & Payouts
Payments are processed through Razorpay. By using the platform, you also agree to Razorpay's terms of service. Seller payouts are processed manually and typically completed within 2-3 business days after deal completion. Sellers must have a valid Indian bank account registered on the platform to receive payouts.
8. Disputes
Either party may raise a dispute on an active deal. SecureSwap's admin team will review the dispute and may resolve it in favor of the buyer, the seller, or split the escrow. The admin's resolution decision is final. SecureSwap reserves the right to request additional information from either party during dispute resolution.
9. Prohibited Activities
You may not use SecureSwap for any unlawful purpose. Prohibited activities include but are not limited to:
- Fraud, impersonation, or misrepresentation of identity or intent
- Money laundering, structuring transactions, or processing proceeds of crime
- Selling stolen, counterfeit, pirated, or illegally obtained goods or keys
- Exchanging illegal, harmful, or prohibited content
- Circumventing escrow mechanisms, velocity limits, or platform safeguards
- Creating multiple accounts to evade restrictions or abuse referral systems
- Using the platform for unauthorized forex transfers or cross-border payments
- Attempting to manipulate domain WHOIS records during a transfer escrow
- Filing false disputes, chargebacks, or fraudulent claims
- Automated or bot-driven deal creation, acceptance, or bidding
Violation of any prohibited activity may result in immediate account suspension, forfeiture of escrowed funds, and reporting to relevant authorities. SecureSwap reserves the right to investigate and take action on suspicious activity at its sole discretion.
10. Platform Monitoring & Safety
SecureSwap employs automated monitoring systems to detect and prevent misuse. These include velocity limits on deal creation (daily and weekly caps), transaction volume caps, cooldown periods between repeat counterparties, disposable email blocking, and KYC verification requirements after a set number of completed deals. All users consent to this monitoring as a condition of using the platform. SecureSwap may flag, suspend, or terminate accounts exhibiting suspicious patterns without prior notice.
11. Domain Transfer Escrow
Domain name deals are subject to additional terms. The seller must be the verified registrant of the domain as confirmed via WHOIS lookup. Payment is held in escrow while SecureSwap monitors the domain transfer via automated WHOIS polling. Funds are released only after the registrant change is confirmed. If the transfer is not completed within 7 calendar days of escrow funding, the deal is automatically cancelled and the buyer receives a full refund. Domain deals are capped at ₹50,000. SecureSwap is not responsible for registrar-specific transfer policies or delays.
12. Pre-Deal Agreement
By accepting a deal invitation, you confirm that you have read and understood the deal terms, the platform fee structure, the dispute resolution process, and these Terms of Service. This acknowledgment is recorded and timestamped for each deal.
13. Limitation of Liability
SecureSwap is provided "as is" without warranties of any kind. To the maximum extent permitted by law, SecureSwap shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability shall not exceed the platform fees collected from your transactions in the preceding 12 months.
14. Modifications
We reserve the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the updated terms. Significant changes will be communicated via email to registered users.
